La justice face au génocide

Le 2 septembre 1998, pour la première fois dans l'histoire du droit pénal international, un homme était condamné pour génocide par le Tribunal pénal international pour le Rwanda (TPIR) d'Arusha. Si la dimension préventive de la Convention onusienne de 1948 (Convention pour la prévention et la répression du génocide) s'était révélée vaine pendant les massacres du printemps 1994, celle-ci allait servir d'assise juridique pour la répression d'une infraction placée au faîte de la hiérarchie criminelle.

In the aftermath of the genocide, the imperative of justice comes up against a major challenge: how to judge all those involved in the massacres? the aim here is to study how judicial institutions of varying scales (from international criminal justice to Rwandan gacaca courts) seized on a crime that first had to be qualified. The originality of the justice policy has its source in the very singularity of the genocide.
