Laurent Serubuga is not justified in maintaining that the director of OFPRA was wrong to consider, on the one hand, that the serious and repeated abuses committed by the army under his command between 1990 and 1992 were responsibility, on the other hand that there are serious reasons to think that the person concerned is personally guilty of complicity in the genocide committed in Rwanda in 1994. Consequently, Mr. Serubuga must be excluded from the benefit of the Geneva Convention pursuant to Article 1^er, F, a of the said Convention.
